Description and Cases Heard

The Law Division hears actions in which the amount of the claim is in excess of $30,000. The type of cases heard include: personal injury, property damage, breach of contract, commercial litigation, Workers' Compensation Act, administrative review under the Unemployment Insurance Act and all tax related matters. The Law Division main offices are located in room 801 of the Richard J. Daley Center; Chief Deputy Clerk, Sherry Walker. The Suburban Districts also accept Law Division filings and, in certain cases, hear Law Division cases in excess of $100,000.00.

Case Types: Civil actions at law, whether or not a jury is demanded, with damage claims in excess of $30,000 for cases filed in Municipal District 1 and $100,000 for cases filed in Municipal Districts 2,3,4,5 and 6. Case type categories include personal injury/wrongful death, property damage, legal malpractice, commercial litigation, libel/slander, and tax & miscellaneous remedies, including replevin, condemnation, Unemployment Compensation review, Workers' Compensation review and administrative review.

Dates: 1871-1964 & 1980 - present  (Since 1964, Law Division cases are retained for  21 years and then destroyed pursuant to statute with a 3% sample of cases retained for  archival/historical purposes)

Courts: Circuit and Superior Courts, 1871-1964; Law Division, 1964-present

Includes: Case files contain names of plaintiff, defendant and attorney of record.  Filings may include cause of action (complaint), defendant's response, motions and briefs filed; testimony (occasional): verdict (if jury trial); and the judge's final order. If the case was appealed, a transcript may be present. Civil cases reflect a variety of topics, including local area business and industry, labor issues, medical (and other) professions, sports and entertainment.
